Universality of jurisdiction in the Succession Regulation

ABSTRACT
The paper discusses the problem of jurisdiction of judicial bodies in succession
matters, which is extremely important in practical terms. Since 17 August 2015,
the Succession Regulation 650/2012 has been applicable in most of Member
States of the European Union. The EU regulation plays an important role in
inheritance cases having a cross-border element.
The primary aim of the study is an attempt to define the nature of jurisdiction
of judicial bodies in inheritance matters. To this end, the provisions of the EU
legislation will be analysed, taking into account the previous scholarly opinion
expressed in the European literature on the problem concerned. The theoretical
and legal considerations will be complemented by the case law of the Court of
Justice of the European Union regarding specific factual states related to the issue
discussed herein.
In summary, the author will try to assess the legal solutions on succession
adopted and implemented in most Member States of the European Union.
