The article is devoted to the problems of the educational function of punishment. The
author analyzes the genesis of one of the concepts justifying the law to punish: the theory
of correctional reform. The article also presents objections to the theory of reform,
in particular drawing attention to the fact that the implementation of punishment in the
form of rehabilitation of the convicted person in many situations is impossible to carry
out due to a number of varying factors being not only the personality of the perpetrator.
The article also seeks to answer the question of why criminal punishment does not meet
expectations in the field of rehabilitation of offenders.
