ABSTRACT
Due to the rapid development of the information society recent years have
brought new technological challenges and related threats to the security of
personal data. The answer to these phenomena was the legal regulation of the
means, rules and institutions that guard the security of personal data.
The purpose of this paper is to analyze the current legal framework applicable
at national level in Poland, to assess legislative changes at the European level,
and to take position on their adequacy. The study is limited to the issues of
securing personal data laid down in Chapter V of the Polish Act of 29 August
1997 on the Protection of Personal Data and to the relevant provisions of the
Regulation (EU) 2016/679 of the European Parliament and of the Council
of 27 April 2016 on the protection of natural persons with regard to the
processing of personal data and on the free movement of such data, included
in section II (articles 32–34). The paper uses mainly the method of legaldogmatic analysis and the comparative method.
