Abstract. Abuse of dominating position in the energy market in light of selected decisions of the President of OfÞ ce of Consumer and Competition Protection. Abuse of a dominating position by companies conducting business in the energy market is a serious threat to existence and development of competition in this market. Actions undertaken by the President of the OfÞ ce of Consumer and Competition Protection (the “OCCP”) and the President of the OfÞ ce for the Regulation of the Energy Industry aim at creating competition and protection of weaker players. Over the past three years, the President of the OCCP issued a series of decisions on the subject of abuse of a dominant position. However, establishing competition in this market is not simple to attain as this a market particularly conducive to a natural monopoly structure.
